These Terms apply to your use of Topsy Wordy, a word puzzle in which you find a six-letter word and build it backwards, for personal enjoyment.
By using Topsy Wordy, you agree to these Terms. If you do not agree, please do not use the app.
The app is distributed through the Apple App Store. Apple's standard Licensed Application End User License Agreement, the Apple EULA, available at apple.com/legal/internet-services/itunes/dev/stdeula, applies to your use of the app.
These Terms are intended to supplement the Apple EULA with product-specific points relating to Topsy Wordy, such as the use of the bundled puzzle library. They do not replace the Apple EULA.
Where these Terms and the Apple EULA conflict, the Apple EULA takes precedence. Where these Terms address matters that the Apple EULA does not, these Terms apply.
Nothing in these Terms or in the Apple EULA removes any rights you have under mandatory consumer protection laws in the country in which you bought or use the app.
Topsy Wordy provides word puzzles, a record of your progress, a star rating for how cleanly you solve each puzzle, a choice of how many puzzles each day offers, an optional daily reminder, optional sharing through your device's share sheet, and an optional App Store review prompt. The app is intended for personal, recreational use.
Topsy Wordy does not provide medical, psychological, legal, financial, educational, or other professional advice. Nothing in the app should be treated as a substitute for advice from a qualified professional.
The app is not intended to produce any particular emotional, personal, educational, or wellbeing outcome.
The puzzle answers are ordinary English words. The word data used to create the puzzles is drawn from a third-party lexical source under its licence; the required notice appears in the app's Acknowledgements, reachable from Settings.
The selection, arrangement, puzzle design, metadata, software, interface, and original copy of Topsy Wordy are owned by Considered Ideas Ltd and are protected by copyright and other intellectual property rights.
You may use the app for personal purposes. You may not copy, scrape, republish, sell, or systematically extract the app's puzzle collection, design, interface, or other content without permission, except where the law allows.
You agree not to misuse the app, interfere with its operation, attempt to reverse engineer it except where the law allows, or use it in a way that infringes the rights of others.
You also agree not to use the app or its contents for unlawful, harmful, commercial extraction, or automated scraping purposes.
The app stores your progress and related data locally on your device. If you delete the app, reset your device, clear app data, or move to a new device without restoring from backup, this information may be lost.
If you enable the daily reminder, the app may schedule a single local notification on your device at the time you choose. Delivery of the reminder may depend on your device settings, notification permissions, Focus modes, Do Not Disturb, operating system behaviour, battery settings, and other factors outside our control.
You can turn the reminder off in the app or through your device settings.
The app may offer optional sharing, for example to share a puzzle challenge or recommend the app. Sharing uses your device's system share sheet. You choose whether to share and which app or service receives the shared text or link.
The app may ask Apple to show the standard App Store review prompt at limited moments. Apple controls whether that prompt appears. Topsy Wordy does not receive or store your rating, review text, or whether you responded to the prompt.
We may update, change, or discontinue parts of the app where reasonably necessary, for example to improve functionality, maintain compatibility, address errors, or comply with legal requirements.
We do not promise that the app will remain available for download, receive updates, or remain compatible with future versions of iOS, devices, or App Store requirements indefinitely. We will try to keep the app reliable, but we do not guarantee uninterrupted or error-free operation.
If the app is sold through the Apple App Store, purchases, refunds, cancellations, and billing are handled by Apple under Apple's own terms and policies.
You should contact Apple for App Store purchase or refund issues unless the App Store directs you otherwise.
Nothing in these Terms limits or excludes liability where the law does not allow it, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your statutory consumer rights.
To the fullest extent permitted by law, Topsy Wordy is provided for personal recreational use and we are not responsible for indirect, incidental, special, or consequential losses arising from use of the app, including loss of data, loss of saved progress, or loss arising from missed or delayed reminders.
Your use of the app is also covered by our Privacy Notice, which explains what data is stored or used.
These Terms are governed by the laws of England and Wales, unless mandatory consumer protection laws in your country require otherwise.
